But a bigger problem arose on Dec. 7, when Sen. Cynthia Lummis suggested that post-Merge Ether was now a security. Lummis is co-author of one of the two major bipartisan crypto regulatory proposals before Congress now that would give the CFTC a lot of regulatory control over the crypto spot market, so her opinion carries a lot of weight.
