A Texas school district is dropping its bid to use eminent domain to seize a man’s home and clear space for parking at its new football stadium.School board trustees in Aldine voted 7-0 Tuesday night to end the legal battle, reversing their previous decision and following months of pressure in the community and growing media coverage.

But Upchurch’s children repeatedly pled with the district to allow their father to remain in his home. His daughter, Tara Upchurch, has said the family is willing to sell the property to the district after Upchurch dies or at least work out an arrangement that would allow him to continue living there. She told Houston-area outletThe land has been in the family since 1916, when their relatives emigrated from Sweden and settled in Aldine as dairy farmers.

In recent months, the district made multiple offers to purchase the land, both before and after trustees authorized the use of eminent domain, according to a report by “The value of our family land surpasses any offer you could present to him,” Tara Upchurch said at a recent school board meeting, as quoted by theOn Tuesday, trustees said in a statement their vote allows the elder Upchurch to retain ownership and landowner responsibilities for the property. “To this end, this matter is concluded and all negotiations have ceased,” trustees said.
