The lawsuit alleged that Llano County Judge Ron Cunningham, county commissioner Jerry Don Moss and library system director Amber Milum removed children’s titles that had received complaints from the community.Nearly a year later, the court found that library officials violated the First Amendment by restricting access to some books based on the materials’ message and content.
The “Butt and Fart Books,” a series of children’s picture books, for example, were taken off the shelves in 2021 after a community group complained they were obscene and promoted “grooming” behavior, according to the court order.Related:Members of that same group that complained later made up the library system’s new board, a move the plaintiffs alleged was done in order to appoint more “politically aligned” members who could then redraft new collection and removal policies.
The libraries closed for three days in December so all of the system’s children’s titles could be thoroughly reviewed. The judge’s order calls for the return of the books to the library system’s catalog as well as to their original location in the physical shelves.
