Tenants in Dallas rarely get justice in court | Opinion

It’s easy to withhold sympathy from someone who hasn’t paid rent and gets evicted. Landlords shouldn’t be forced to shoulder the burden of a housing crisis any more than tenants should be forced out of their homes on account of a global pandemic. But there’s more to this story. The law requires that certain eviction notices be given to the tenant, and in a very specific way and timeline. If those notices are not given, or not given properly, the law says, the eviction should be dismissed. But it rarely goes that way.
I called a judge recently to tell him he was violating a Supreme Court order by rescheduling eviction cases the Supreme Court said must be dismissed. He responded that he wanted to be sure that landlords know what is happening before they lose their chance to evict. I asked if he also made it a practice to violate Supreme Court orders when it gives tenants an advantage. Silence.
