Tate Modern 'nuisance' viewing platform could be removed after court rules it invades privacy
“I get the impression because of where this has gone and the individuals involved that money isn’t an object, and I imagine they will fight tooth and nail to try and get this gallery removed or maybe it’s got to be bricked up so it doesn’t overlook them.”
In his majority judgment, Lord Leggatt said the lower courts had found that the living areas of the flats – which have floor-to-ceiling windows – were under “constant observation from the Tate’s viewing gallery for much of the day, every day of the week”. Ms Lamkin said the case had quite unusual and “extreme” facts but that it could spark a wave of copycat claims where people feel a property development near them is highly intrusive.
