For the first time in a century, the U.S. Supreme Court announced Monday that oral arguments scheduled to begin March 23 will be postponed due to coronavirus, delaying hearings on cases including a major copyright case between Google and Oracle and a dispute over subpoenas for President Donald Trump’s tax returns.
The move is not without precedent: the court postponed arguments in October 1918 during the Spanish Flu outbreak, and in 1793 and 1798, the court shortened its argument calendars because of yellow fever outbreaks. The court is also expanding remote working capabilities, and some justices may attend their Friday conference over the phone.
Six of the nine justices are over the age of 60, including Chief Justice John Roberts, 65, Justice Clarence Thomas, 71, Justice Ruth Bader Ginsburg, 83, Justice Stephen Breyer, 81 and Justice Sonia Sotomayor, 65. Adults over the age of 60 are considered to be at higher risk for serious complications from the coronavirus. Google vs. Oracle, which is among the cases for which the hearing this month is postponed, is expected to have major implications for the tech industry. The court is expected to rule on whether software interface is subject to copyright laws as other intellectual property is. How the court’s calendar will be further affected.
