Linda Fairstein, prosecutor in the Central Park Five case, is suing Netflix and Ava DuVernay for defamation
Fairstein was the head of the Manhattan District Attorney’s sex crimes unit during the case in which five young black and brown men were convicted of the rape and beating of a New York jogger. The convictions were vacated in 2002, and the five received a $41 million settlement from the city more than a decade later.The former prosecutor’s lawsuit accuses Netflix and DuVernay of multiple counts of defamation, saying Fairstein was wrongly depicted as a racist and unethical villain.
The lawsuit is seeking unspecified damages, including punitive damages, as well as injunctive relief against further alleged defamation by DuVernay and the other defendants. This is not the first time Fairstein has attacked the series, in which she was played by Felicity Huffman. After the series debuted, Fairstein was dropped by her publishers in the U.S. and Britain, as well as her literary and film agency, ICM Partners. The moves followed publicover her role in the case. Fairstein’s complaint says she’d also lost business from canceled speaking engagements and legal consulting jobs because of the fallout from the series.

Asshole Who Led Central Park 5 Prosecution Mad Enough About Ava DuVernay's Movie to SueLong before the Central Park Five became synonymous with a miscarriage of justice–a worst-case example of violence perpetrated by the legal system–a judge specifically referenced the actions of the woman who led the case’s prosecution, Linda Fairstein, in its result. The five boys, between 14- and 16-years-old at the time, had been convicted of several rapes in Central Park with little evidence beyond a series of confessions, elicited after hours of interrogation. (The boys weren’t exonerated until almost a decade later when, in 2002, another man confessed to the crime.) On December 16, 1993, denying the appeal of one of the five, Yusef Salaam, New York Court of Appeals Judge Vito Titone wrote that the case’s interrogation methods were exploitive by design: “There can have been no other reason for [Farstein’s] decisions [...] other than to capitalize on his youth and isolation.”
