Embarrassing details Fox News and Murdoch want kept out of court in $1.6bn Dominion trial
The judge had already ruled that Fox cannot contest that the statements it aired about Dominion were false and harmful to the company: claims that the company was involved in election fraud; had developed an algorithm that rigged vote counts; was “owned by a company founded in Venezuela to rig elections for the dictator Hugo Chávez”; and paid kickbacks to government officials.
Legal experts say that the location of the trial has sparked more doubts about Fox’s prospects in the legal battle. It is scheduled to be held in Delaware, where Dominion is based. Jurors will be drawn from among the state’s electorate, which voted overwhelmingly for Joe Biden in 2020. They might relish a chance to vote against Rupert Murdoch as well as Donald Trump.
Above all, an out-of-court settlement could spare Fox the embarrassment of seeing weeks of damaging evidence aired nationally. Pre-trial disclosure revealed reams of internal communications, with Fox hosts attacking one another and fiercely criticising Trump. High-profile Fox presenters such as and Tucker Carlson, as well as Murdoch himself, might be called to the stand. He probably wouldn’t like that.
