Dominic Fletcher, 25, uploaded photos of himself in 'intimate' situations with his former partner onto FabSwingers
A dentist who illegally shared intimate photos of his ex on a website for swingers while "advertising" himself to others has failed in his bid to overturn his conviction.
Fletcher had sought to obscure the identity of his ex by drawing a black band across her eyes – but the shocked pal recognised her and raised the alarm. Police were contacted, and Fletcher was convicted of sharing the explicit photos without his former partner's permission at Dundee Sheriff Court in August 2022.
However advocate depute Michael Meehan KC, for the Crown, said that the legal threshold for the offence had been passed, and that Fletcher had acted "recklessly for his own ends". He added that campaigners for the law felt the 'revenge porn' label was "unhelpful", given how the law stands in Scotland.
She wrote: "The appellant was not motivated by a desire to embarrass or humiliate the complainer. He was, however, motivated by a desire to further his own ends; to gain popularity on the website by uploading what he considered to be images which would make him more attractive and appealing to other users.
