“A First Nation Chief should be expected to be one of the bulwarks of First Nation democracy,\u0022 the judge wrote. “Here Chief Wuttunee was not.”
Wuttunee and Nicotine were elected in 2020 along with seven other councillors, but some members of the First Nation alleged the candidates engaged in “serious electoral fraud,” including vote-buying and forgery, according to court filings.
In a judgement issued on March 30, Brown pointed to a multitude of reasons for annulling Wuttunee’s election. Brown also found that Councillor Gary Nicotine was “directly involved in instances of serious electoral frauds related to vote buying.”
