A new Ohio House bill and a promised Ohio Senate bill aim to protect Ohio patients and hold doctors who engage in misconduct accountable.
Legislative efforts are underway that lawmakers and state leaders say will better protect Ohio patients and empower those tasked with holding physicians accountable.which would prohibit medical providers from conducting intimate exams unless medically necessary or for certain other exceptions.that never gained traction during the previous legislative session will be reintroduced imminently.
An intimate examination is within the scope of care for the surgical procedure or diagnostic examination to be performed on the patient Hillyer said patients might be giving blanket consent for such procedures when signing pre-surgery documents, but it’s often not informed consent, where patients fully understand they may be given an intimate exam while under anesthesia.
Representatives of the Ohio State Medical Association, meanwhile, have reviewed the bill and “don’t believe such instances are occurring in Ohio.” The bill would also allow the board to automatically suspend a doctor’s license for 90 days if a doctor is indicted or if a license was suspended, revoked or surrendered in another state. A public member of the medical board would be added to the investigatory team to increase oversight.
Baker of the Ohio State Medical Association said the group discussed the legislation with the medical board last year. The association would review the bill again if it is reintroduced this year to develop its position and would work with the board and legislature as the bill proceeds, he said.Tierney said the governor’s office is “supportive of the concept” of HB 89 and is always open to discussing ways to better protect the public.
