Judge Eric R. Linhardt, in disagreeing, acknowledged in a recent opinion that Pophal’s argument is unique because “no provision of the Marriage Law or Divorce Code explicitly addresses attempts to marry after a marriage license has expired. Neither statute specifies the consequences for purporting to marry without a valid license, he wrote.
He contends his interpretation is in harmony with a 1969 Superior Court decision issued before the enactment of the current Marriage Law and Divorce Code. That ruling stated: “This sort of gamesmanship is frowned upon in the law and discouraged unless necessary to vindicate some powerful countervailing interest,” the opinion states.
