The Ohio Supreme Court ruled Wednesday that the state’s law that forbids trains blocking railroad crossings for more than five minutes is unenforceable.

COLUMBUS, Ohio –

An appellate court reversed and reinstated the charges, prompting the rail carrier to appeal to the Ohio Supreme Court.as an attempt to keep crossings open for movement of emergency vehicles., noted that under the U.S. Constitution, “Congress may preempt state authority by so stating in express terms.”

Kennedy noted that while keeping crossings open for emergency vehicles was an important matter of public safety, it was not one of railroad safety.
