The Ohio Senate sent a bill to the House on Wednesday that would update Ohio burial and cremation laws and that neutralizes, for now, a battle between the cemetery and funeral home industries.

But those proposed cemetery regulations were removed in recent amendments and replaced with a requirement that state regulators issue a report to the Ohio General Assembly that would compare pre-planned funeral casket requirements in Ohio to those in other states., sponsored by Sen. Jerry Cirino, a Lake County Republican, would make over a dozen changes to funeral and burial laws. It would increase fees to reactivate an embalmer’s or funeral director’s license from $140 to $200.

At issue in the battle between the cemetery and funeral home industries was the amount that cemeteries must hold in trust when they sold caskets for pre-planned funerals. The trust would hold money to guarantee the casket upon the person’s death, in case the cemetery or funeral home goes out of business.
