The confirmation of Berkeley's new police chief may be upended because of alleged misconduct that one former officer says occurred during her time as the interim chief.

on Tuesday at 6 p.m. Mizell is asking the council to delay that confirmation until his board conducts an investigation into whether the statements from the former officer are accurate. "Hastily confirming the Interim Chief now would severely undermine public confidence in the independent oversight that Berkeley citizens voted for in establishing the Police Accountability Board," Mizell wrote in his statement."It will also erode the City's ability to 'promote public trust,' a responsibility the City Charter entrusts the Board, and the City as a whole, to uphold. There is no conscionable way for the confirmation to go forward tomorrow.
Mizell's statement said the misconduct allegations center on group text exchanges between officers in the bike unit of the department's downtown task force. Specifically, Mizell wrote, the allegations focus on texts sent by that unit's supervisor, Sgt. Darren Kacalek, who is also the president of the Berkeley Police Association.
Mizell said Kacalek allegedly ordered officers in the bike unit to make"100 arrests per month." He also allegedly made"anti-homeless" and racist remarks in text messages, including one in which he suggested"homeless individuals in the city could be 'wipe[d] out' and that the bike unit would 'ride by the bodies.
