A Network Rail worker has been allowed his licence back
to travel to sites between Derby and Stoke on New Year nightshifts. Richard Derby, 39, of Conway Close, St Ann's, appeared at Nottingham Magistrates' Court where an application to suspend his driving ban pending appeal was granted.
Derby is waiting to appeal sentence and conviction for failing to provide a sample of breath for analysis, and received a driving ban on December 15. But the court heard on Friday Derby is significantly impacted by the fact he has lost his licence. He has been employed by Network Rail for four years and quite often works nights, spanning between Stoke and Derby, where he visits maintenance sites, and needs his driving licence to reach them in a British Rail vehicle.
As no date has been set for his appeal, magistrates suspended his disqualification, allowing him to drive until the outcome of his case at the crown court. But they warned the ban "hasn't gone away".
