The NBA told SFGATE that players will continue to be blocked from promoting cannabis companies or launching their own brands, contradicting earlier reports on the new collective bargaining agreement.

In addition to cannabis not being on the banned substance list, the penalty for testing positive for prescription drugs like Xanax and Valium without a prescription will be reduced from a two-year penalty to a 25-game suspension, according to two sources with direct knowledge of the negotiations.

Players will still be banned from consuming synthetic cannabinoids like Delta-8 THC, according to one source with knowledge of the negotiations, although it’s not clear exactly what the punishment for testing positive for synthetic cannabinoids would be. That could cause enforcement problems for the league, as synthetic cannabinoids are often derived from non-intoxicating CBD and it’s difficult to differentiate synthetic cannabinoids from natural cannabis on drug tests.

This new agreement could make NBA athletes the leading faces of the CBD movement, according to Jesse Burns, the chief marketing officer of the public relations firm Grasslands. Burns said players have an opportunity to “really leverage this moment of health and wellness” by creating their own CBD brands.
