New Jersey DEP is suing the city of North Wildwood over plans to build a bulkhead, from 13th to16th Avenues, to reinforce the sand dunes.A Jersey Shore town can move forward with litigation against the state to recoup as much as $21 million it spent over the years to fortify local beaches against severe erosion.

“I’m grateful the judge recognized the serious imminent danger facing North Wildwood and is allowing this case to proceed in court where we’ll have an impartial judge weighing in and not just the unilateral conflicted decision-making of the NJDEP which is what we’ve been dealing with for years now,” North Wildwood Mayor Patrick Rosenello told NJ Advance Media on Wednesday afternoon.

“There is no protection now,” he said Wednesday. “A minor to moderate coastal storm is going to cause infrastructure damage ... but by the grace of God, we’ve had a mild January. Hopefully, it’s a mild Spring.” Rosenello said $21 million equates to money needed over the years to truck in sand to replenish beaches and safeguard families and visitors amid worsening erosion brought on by climate change.
