The marks the fourth time Santa Clara County prosecutors have filed murder in a case alleging a drug dealer sold the deadly opioid under the guise of it being a less-powerful narcotic.

SAN JOSE — A Monterey County man has been charged with murder in the fentanyl-overdose death of a San Jose woman earlier this year, with South Bay prosecutors alleging that he sold drugs that he knew contained the deadly opioid, but duped users into thinking they were consuming something less powerful.

His cousin, a 31-year-old Marina man, was charged alongside Kupka only on the drug counts. Authorities alleged he served as a runner for Kupka in delivering fentanyl, including to an undercover police officer who was part of the investigation underpinning the criminal charges. An autopsy by the county Medical Examiner-Coroner’s Office determined that Matchulat died from fentanyl toxicity that compounded other health conditions.

But he also reportedly told undercover investigators that “it is not his job to know” what other drugs or substances are used to make the pills, and advised an investigator to “keep the stuff that wakes a up.” Prosecutors believe that was a reference to the emergency opioid antidote Naloxone, and evidence that Kupka knew what he was selling was deadly enough to need a revival remedy on hand.was filed in 2020 against Anthony Minjares, now 24, in the death of an 18-year-old Santa Clara woman.
