Nakota Kelly was 10 years old when he disappeared during a court-ordered weekend visitation with his father in July 2020. Now his mother is suing.
Kelly Wilkinson, [email protected], a 10-year-old boy who disappeared during a weekend visitation with his father, has filed a tort claim against the Indiana Department of Child Services seeking damages for wrongful death and negligence.
The weekend of July, 17, 2020, Nakota was scheduled to be with his father for court-ordered visitation. But Nakota and Dibiah had recently gotten into an argument, Kelly previously told IndyStar, and the boy had hung up on him. That Friday, Kelly dropped Nakota off to his father following a Little League game. Because of the game and the drive to Kokomo, the halfway point between their homes, visitation started later than usual.
