At least at first, as I am sure the GOP would extend such segregation to others. They may be claiming that this is meant to level the playing field for sporting events that include transgender players, but this document goes far beyond that concept. It would be bad enough if it was only Attorney General Ken Paxton supporting it, but the fact that it is being introduced in Congress is just plain terrifying to me as a female and as a human being.
For a state so laser-focused on preventing abortions, one would think the state’s Republican leadership would address the clear threat that natural gas extraction operations pose to the hundreds of thousands of Texas women who live near them.Re: “Chief justice defends ‘legitimacy’ of court — Controversial ruling ‘not a basis’ for attacks on institution, he says,” Sunday news story.
Then, the Republicans on the Supreme Court ignored legal precedent and the principle of stare decisis, choosing for the first time in U.S. history to take away a right that women had for 50 years. In essence, the justices did not act like a legitimate court. They acted like partisan legislators. That is the very definition of “activist judges” that Republicans used to complain about.
Textual analysis of the Constitution, no matter how sophisticated the jurisprudence, is not the application or rending of justice. The Hippocratic Oath to “First, do not harm” could well apply here. It is an academic enterprise devoid of any larger social value. We do not care what the “original intent” of the long-gone framers was. What we care about is if their legacy gives us guidance in meeting the challenges of today’s society.
