A Superior Court judge will determine on Nov. 30 what happens next and if the case goes to trial
A Superior Court of San Diego County judge said Friday he will issue a ruling on Nov. 30 on whether a lawsuit seeking to throw out the multimillion dollar utility franchise agreement the city of San Diego signed last year with San Diego Gas & Electric will move forward., after listening to nearly two hours of arguments by lawyers for SDG&E, the city and attorneys representing San Diego resident Kathryn Burton.
However, if for any reason the city is unhappy with SDG&E, it has a window to void the 10-year renewal, provided two-thirds of the City Council votes against extending the deal. A representative for the city countered that discussions prior to the votes between Gloria and city council members — as well as talks between city officials and SDG&E — were above board and did not violate any open meeting guidelines.
Aguirre said the public “didn’t even get to see what their city officials did” before they signed off on the franchise agreement. “Where we want to go is to a trial,” he said.
