Nathaniel Moore accuses prison official of unlawfully giving his records to his ex-girlfriend, a deputy district attorney and daughter of the former assistant district attorney, for use in custody dispute
Former Assistant District Attorney Jesse Rodriguez sought evidence for possible criminal charges against a man locked in a family law dispute with his daughter. DA Summer Stephan said she was unaware of the investigation.Pope and the California Department of Corrections and Rehabilitation are named as defendants in the new lawsuit, filed Tuesday in San Diego federal court, while Jesse and Elizabeth Rodriguez are not.
Moore could not be reached for comment, and his attorney did not respond to messages seeking comment. Pope could not be reached for comment. Just weeks before he retired in December 2018, Jesse Rodriguez ordered district attorney personnel to launch a secret investigation of Moore, according toin 2019 under the state Public Records Act. The probe focused on finding evidence that Moore had committed fraud or perjury related to a 2017 unemployment claim.
