HGV driver Daniel Masiulis has been locked up for seven years for causing Clive Pinnock's death by careless driving
A BMW driver who killed a father-of-three while over the legal drink-drive limit has been jailed for seven years. Daniel Masiulis, who a court heard on Tuesday was convicted in 2016 of failing to provide a specimen for analysis after suspected drink-driving, showed no emotion as he was led away from the dock to begin his sentence.
Masiulis, of Baguley Street, Droylsden, Tameside, then went to a shop in nearby Abbey Hey and bought vodka and Coca Cola before ringing police, the court heard. A blood test showed he had 129mg of alcohol in 100ml of blood, the legal limit being 80. Mr Pinnock, 38, was travelling in the opposite direction on a green and blue Kawasaki Ninja ZX-10R bike and as Masiulis turned, Mr Pinnock hit the vehicle at 'high speed' and was thrown into the air off his bike. He suffered traumatic brain injuries and a broken neck and pelvis and was pronounced dead later that evening.
At a sentencing hearing at Bolton Crown Court on Tuesday, judge Tom Gilbart said Masiulis' driving before the crash was 'rushed and erratic', but said Mr Pinnock's riding was 'irresponsible'. Judge Gilbart said Masiulis' drinking 'clearly impaired' his decision-making. He told him, referencing the buying of vodka: "You ran away from the scene. You were over the legal limit and you set about trying to cover for that. I am quite satisfied that you knew you were over the limit."
"We will all make sure that Clive will always be talked about. I cannot grieve for my son without some kind of justice. I just want my son to rest in peace."
