The Justice Department has threatened to request executive privilege over Mueller’s report if the House Judiciary Committee does not cancel plans for a contempt vote against AG Barr.

“If the committee decides to proceed in spite of this request, however, the Attorney General will advise the President to make a protective assertion of executive privilege,” Boyd wrote. The Justice Department’s letter said that providing all the materials requested by Democrats would put ongoing investigations at risk, and in the case of grand jury material “force the Department to ignore existing law.” Assertion of privilege would be consistent with past administration practice.

Should the committee vote to accept the report and hold Barr in contempt, the resolution and report will move to the floor for a full vote in the House to authorize legal proceedings.
