SAN FRANCISCO — A Vallejo man who was out on bond facing federal charges of robbing a pharmacy when he allegedly made off with a truck full of prescription drugs was sentenced Wednesday to seven years and five months in prison.
Lembrent Rubin, 37, was sentenced by U.S. District Judge Charles Breyer after pleading guilty to a federal robbery charge. Rubin has been in Santa Rita Jail in Dublin since his September 2019 arrest; he allegedly stole a pharmaceutical delivery truck outside of the Costco in Vallejo and had a loaded gun in his possession when he was arrested at a nearby apartment complex a short time later.
Prosecutors asked for a sentence of 11 years and 10 months, writing in court records that Rubin had been caught with loaded guns five times from 2015-19, and that he was a suspect in a nonfatal shooting in San Francisco. “Up to this point, has spent just days in jail pursuant to his state gun convictions, and the government recognizes that a sentence of more than a decade in prison represents a substantial escalation in punishment,” two U.S. Attorneys wrote in a sentencing brief. “However, the defendant’s criminal conduct dangerously escalated over the years leading up to the robbery, and at the same time, the defendant demonstrated little respect for the justice system.
In the October 2018 robbery that led to the federal charges, Rubin entered a Safeway in San Francisco, got behind the counter of the pharmacy inside, brandished a gun, and demanded methadone, prosecutors wrote in court records. He was indicted in late November 2018, and two weeks later U.S. Magistrate Judge Sallie Kim released him on a $50,000 bond.
