Gun groups are trying to reclaim the right to carry at an array of public places, including medical offices.
Locked in a legal showdown over concealed carry, New Jersey Second Amendment groups are pushing a federal appeals court to expand the places firearms are permitted to include playgrounds, youth sporting events and medical offices, court filings show.
The bill Murphy signed prohibited firearms from so many locations that even sponsors of the legislation struggled to list the places they’d be permitted. An initial court ruling threw out many of those restrictions, but the U.S. Court of Appeals for the 3rd Circuit allowed enforcement through the emergency stay.
The gun groups also argue a new $200 permitting fee and a requirement an applicant submit statements from “four reputable persons” attesting to their character are “patently unconstitutional.” Some places appear to be off the table for concealed carry, according to the legal filings. Courthouses, public schools and other buildings where government business is conducted will likely remain off-limits.
“But the state overlooks critical features of schools that make them nothing like off-campus locations, and it comes nowhere close to demonstrating that earlier generations protected the vulnerable by leaving them defenseless.”
