GOP drawing battle lines over bringing Justice Alito 'leak' source to Senate
The minister, the Rev. Rob Schenck, told the New York Times earlier this month that he learned of the court's 2014 decision on Burwell v. Hobby Lobby weeks in advance from people close to Alito. This prompted a Nov. 20 joint letter from Sen. Sheldon Whitehouse and Rep. Hank Johnson , chairmen of the Senate and House judiciary courts subcommittees, respectively, asking the high court for explanations.
When asked if he would contest any potential effort to subpoena Schenck, Cruz said,"Yes." So far, no Democrats on the committee have called Schenck to testify despite continued interest in Schenck's allegations by some members and dissatisfaction with Torrey's response. Any effort to call Schenck as a witness likely wouldn't happen until next year after the new Congress is sworn in. Likewise, Democrats are attempting to keep Sen. Raphael Warnock in place when he faces Republican Herschel Walker in the Dec. 6 runoff to obtain a 51-49 majority in the Senate.

Letter: 'Nothing to suggest' Alito violated ethics standardsThe Supreme Court said Monday in a letter to Congress that there is “nothing to suggest” that Justice Samuel Alito violated ethics standards following a report that a 2014 decision he wrote was leaked in advance of its announcement. In a 5-4 decision, Alito wrote that some companies with religious objections can avoid the contraceptives requirement in President Barack Obama’s health care legislation. In the Times story, Rev. Rob Schenck said he was told the outcome of the 2014 decision by Gail Wright, a donor to an organization he headed who had dined with Alito and his wife.
