In a 67-page, largely procedurally focused ruling in the Texas case, Kacsmaryk found that a coalition of anti-abortion medical groups and physicians had standing to sue over the approval and that the group had presented sufficient evidence of possible harm caused by the drug. The process for revoking the drug’s approval is unclear, as there has never been a situation quite like this in which a single judge overruled the FDA. The agency has its own administrative procedure that involves public hearings and often-lengthy scientific deliberations.
