Abortion rights advocates say talk of respect for precedent at nomination hearings was nothing more than a sham.
The draft opinion – regarding a challenge to a Mississippi abortion law – has massive implications for abortion access across the country generally and in the state of Texas specifically.Politico reported that five justices voted to overturn Roe and as of Monday continued to back that position: Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett.
“First of all, the more often a decision is reaffirmed, the more people tend to rely on it, and second, I think stare decisis reflects the view that there is wisdom embedded in decisions that have been made by prior justices who take the same oath and are scholars and are conscientious, and when they examine a question and they reach a conclusion, I think that’s entitled to considerable respect,” he said.Gorsuch touted the benefits of following past precedent during his own hearing.
The opinion cites a number of instances where the Supreme Court overturned precedents in the past. Perhaps the most famous of those was in Brown vs Board of Education, when the court rejected its earlier “separate but equal” doctrine that had allowed for continued racial segregation in schools and other facilities.
Collins said this week that the leaked draft would be “completely inconsistent” with what Gorsuch and Kavanaugh said in their hearings and in meetings with her. “What I think the nominees were doing was trying to give senators who were wavering some reassurance while not making any concrete promises,” Carpenter said.
Supreme Court nominees are under tremendous scrutiny when it comes to issues such as abortion, said Lynne Rambo, professor of law emerita at Texas A&M University. As a member of the Judiciary Committee, Sen. Ted Cruz, R-Texas, pushed for confirmation of President Donald Trump’s nominees to the Supreme Court, including Gorsuch and Kavanaugh.
