Danger Mouse's Beatles/Jay-Z mashup 'The Grey Album,' released online 16 years ago this week, could never happen today. Here's why that's a shame
After piecing the album together in his bedroom studio in a few short weeks, Burton pressed up 3,000 CDs.
But some copies did end up for sale on eBay, among other outlets, and others popped up online. Jay-Z and Paul McCartney both seemingly had no issues with; Damon Dash, then working for Jay-Z’s Roc-A-Fella label, enthused about the way it brought “two great legends together.” But EMI, which controls the publishing rights for the Beatles’ records, was not so forgiving and sent Burton a cease-and-desist order, after which he yanked it from his website.
To protest EMI’s action, nearly 200 websites offered free downloads of the album on February 24, 2004 — “Grey Tuesday,” it was called. Those sites were also hit with legal letters, but that day, more than a million copies ofwould have been one of the best-selling albums of that year.sounds almost primitive; the musical stitches are easier to spot, and at times it feels a little forced. But the album remains startling and clever .
Would we get to hear such an experiment now? To be sure, the album worked wonders for Burton, who made a name for himself with it and went on to produce records for U2, the Black Keys, Norah Jones, Beck, and others, and become half of Gnarls Barkley. But far more so than in the post-Napster days of 2004, the music business is on edge about copyright infringement.
