“We fought to a standstill with the court dismissals and we haven’t stopped selling checks,” said Teddie Garrigan. “That’s a win.” “It’s scary to get a letter like that,” Courtney Garrigan said. “At first I thought it was a joke and then it wasn’t.” Legal expenses came at a bad time as their store rent tripled last year. They tried to find a building to purchase, but couldn’t find one in Dallas’ escalating real estate market that they could afford.

The sofa, pricey on its own right at $13,500, was purchased by an unnamed customer, a Dallas attorney, who wanted it as a conversation piece. The sofa became a “roadside attraction” after people read about Coco & Dash’s legal problems. They came to take photos with the blue and white sofa. A bigger question she was hoping to find out in court was how Hästens was able to obtain the trademarks for a “repeating pattern of four adjoining squares” in the first place.“I want to go to Washington, D.C.,” Teddie Garrigan said. “Someone didn’t have their eye on the ball when they granted these trademarks.”Legal maneuvers started last year when Hästens attorney in Washington D.C. refused to be served with a complaint filed by the Garrigans in Dallas federal court.

Chhabria said Hästens “can’t seriously argue” its claim that the California federal court had jurisdiction because Coco & Dash sold a couple items to California consumers through“Those sales were for non-furniture items that bear no relation to the trademark claims or issues in this case,” the judge said.
