Often, class-action lawsuits aren’t about reforms. They are about using and abusing our judicial system to generate wealth and status for attorneys.If you have watched television, streamed a movie, spent time on social media or searched online, you have probably seen advertisements from trial lawyers looking for plaintiffs to join various class-action lawsuits. Common targets are consumer products, pharmaceuticals, medical devices and chemicals.
Now, don’t get me wrong: Companies should be held accountable for product safety and negligence in proportion to the true harm and damage they have caused, but many mass tort lawsuits are orchestrated campaigns that aim to make trial lawyers rich. Tort reform efforts at the federal and state levels are needed, but in the meantime, what are companies to do? Their fiduciary obligation to their shareholders means they must pursue any legal means to preserve shareholder value, protect their employees, minimize losses and maintain future capacity.
