A Cuyahoga County Common Pleas Court judge ordered Cleveland to refund tax withholdings to a doctor who had been working out of state.
Aerial of Cleveland City Hall, May 2022CLEVELAND, Ohio – The Buckeye Institute, which challenged Ohio’s pandemic municipal tax rules to permit taxing people where they were neither working nor living, has won a case involving the city of Cleveland.
“In ordering a refund to Dr. Morsy, the court reaffirmed the fundamental right of due process and reminded local governments that they cannot tax nonresidents for work that was performed outside of the state of Ohio,” Robert Alt, president and chief executive officer ofThe Cleveland case is one of five brought by the Buckeye Institute, including those in Toledo, Columbus and Cincinnati.
