James Witham was arrested more than three weeks after he shot council worker dead
The man who has admitted firing the shot that killed Ashley Dale in her home told a police officer he had been "set up" and said the car used by the gunman belonged to another man.
Witham, who has since pleaded guilty to manslaughter, and Peers were arrested when a black Audi Q7 was stopped by an armed patrol on the M6 in Cumbria, on September 13, 2022. Both men had previously been in Scotland together, after leaving Merseyside on September 4. Mr Langhorn said it was after his third interview on September 15 that Witham made some comments to an officer as he was being led back to his cell. The jury said Witham complained to the officer that he was “being set up” and added the car was “Davo’s”.
Mr Langhorn also gave the jury evidence about cash deposits to a bank account belonging to Witham. He said detectives found there had only been seven deposits of cash throughout 2022. During the prosecution opening, Lead prosecutor Paul Greaney, KC, said: "The men who had damaged the car were not deterred. Fifty minutes later, at about 12.30am, they returned. This time, they were not to be diverted from their intention to kill. One of the men approached the front door of 40 Leinster Road and he kicked it in.
The jury has already heard Ashley's boyfriend, Harrison, had been "best mates" with Barry before an alleged fall-out a number of years ago, which Ashley described as causing "heavy beef" between the two men.
