Andreas Gal, an American citizen, was asked to turn over the passwords to his mobile phone and laptop, which were both owned by Apple.
Customs and Border Protection officers violated a citizens rights when they demanded he turn over passwords to his electronic devices at the airport, the American Civil Liberties Union Foundation of Northern California said in a civil complaint filed Tuesday.
“This request seemed to aggravate the customs officers,” he wrote in the post titled “No one should have to travel in fear” published Tuesday. “They informed me that I had no right to speak to an attorney at the border despite being a U.S. citizen, and threatened me that failure to immediately comply with their demand is a violation of federal criminal code.”Eventually, the officers let Gal leave, but not before stripping him of the Global Entry card that gave him expedited travel privileges.
The ACLU Foundation alleges that Gal was subjected to interrogation and retaliation by customs officers, according to the March 28 complaint sent to the Department of Homeland Security. The group is demanding an investigation into whether Customs and Border Protection violated the First and Fourth amendments, and has called for a review of the agency’s border search policies.
