With the stroke of her pen, Gov. Gretchen Whitmer repealed an unenforceable Michigan law Wednesday that makes it a felony to administer most abortions with no exception for rape or incest.
Michigan Governor Gretchen Whitmer repealed a 1931 abortion law that banned abortions and criminalized medical personnel who assisted in the procedure. For decades, the 1973 U.S. Supreme Court's Roe v. Wade decision guaranteed a national right to abortion. But when the court overturned that decision, a Michigan Court of Claims judge issued an order temporarily blocking Michigan's abortion ban to ensure continued legal access to the procedure in the state.
Michigan voters ultimately took up the matter directly during last year's midterm when they embraced an amendment to the state's constitution to enshrine an explicit right to seek abortions. While the constitutional amendment means the 1931 abortion ban is no longer in effect, Democratic lawmakers still wanted to repeal it.
"Today, we're going to take action to ensure that our statutes, our laws reflect our values and our constitution," Whitmer said in front of a wall of pink signs reading"bans off our bodies" at a bill signing ceremony packed with Democrats and abortion rights advocates.

Whitmer strikes 1931 abortion ban from Michigan lawMichigan Gov. Gretchen Whitmer signed legislation Wednesday repealing Michigan's abortion ban from 1931 that made it a crime to assist in an abortion. Whitmer and other Democratic leaders stressed that it was important to strike the law from the state's books to ensure it could never be enforced again. Wednesday’s signing marked another victory for abortion rights supporters after voters in Wisconsin elected a Democratic-backed Milwaukee judge Tuesday to the state’s Supreme Court, ensuring liberals will take over majority control of the court with the fate of the state’s abortion ban on the line.
