Attorneys general from 23 states and Washington, D.C., called on a federal court to block Texas’ near-total ban on abortion
Getty ImagesThe attorneys general asked the U.S. District Court for the Western District of Texas to rule in favor of the U.S. Department of Justice by immediately blocking the Texas law, known as Senate Bill 8 , alleging the policy violates the 14th Amendment and should be struck down now while the case moves forward.
The officials said they had an interest in the case given that residents in their states could potentially need an abortion while in Texas, clinicians in their states could also perform abortions in Texas, and anyone in their state who helps a Texan get an abortion could be open to legal liability under SB 8, which allows private citizens to sue anyone who “aids and abets” an abortion.
The AGs also noted that Texans are now seeking abortions outside of the state as a result of the ban, putting a strain on those states’ resources, and such impacts have already been seen or are expected in states that signed on to the amicus brief like New Mexico, California, Colorado, Illinois and Nevada.
Ruling in favor of the Texas law could broadly have “significant implications for the 14th Amendment and for the rule of law” by making it easier to enact policies that target other groups like people of color and LGBTQ Americans, the attorneys general argued, as courts have historically rejected such policies because they would violate the 14th Amendment’s equal protection clause.
The states that signed on to the amicus brief are Massachusetts, California, Colorado, Connecticut, Delaware, the District of Columbia, Hawaii, Illinois, Maine, Maryland, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, Washington and Wisconsin.
