According to an arrest-warrant affidavit, Pino initially told detectives he was in a vehicle with Montes when someone shot at them from another vehicle. Police said they concluded this narrative was false after determining that the bullet was fired upward inside the vehicle and reviewing street-camera footage.Pino then told detectives Montes was trying to take photos with the gun and accidentally shot himself in the head, according to the affidavit. Pino said he threw the gun out of the car.
Although Montes’ death was ruled a homicide and his autopsy report was received by police in February 2022, the affidavit does not describe any investigative work conducted between then and this month, when a new detective was assigned to the case. Arlington police did not immediately respond when asked why it took a year and a half to continue investigating in the case.
